Summary:
The EU regulation of patent rights in the field of medicines constitutes an extremely interesting subject of analysis both in the light of industrial property law and competition law as well. The field of medicines combines not only huge economic significance as a highly evolving and developing sector, but also biotechnological issues that need extraordinary attention and regulation in terms of innovation, fragility, public's interest, social awareness and protection. In the first part, issues and legal matters concerning the law of industrial property and patent rights in the pharmaceutical sector will be analyzed, while the documentation will be based on the jurisprudence of the European Court of Justice and its case law transformations, developments and clarifications.
In the second part, the interconnection of patent rights and competition law will attempt to be thoroughly presented and in particular the subjects that refer to the Art. 101 and 102 of the Treaty on the Functioning of the European Union (TFEU) as the uppermost goal and orientation of protecting the internal market and competition of EU.
