Summary:
The present study attempts to bring out the meaning of Marine - labour accidents, as well as the legal protection of the sailor if such an event occurs. The study is structured in two parts. The first (A’) part, and for the purposes of the “Definition of Marine - Labour Accidents”, will present: 1) The meaning of a labour accident in accordance with law 551/1915 for employees not subject to IKA insurance - Sailors, and in particular I. the meaning of maritime employment and, II. the definition of a marine - labour accident, 2) Special cases - types - events which (do not) constitute a marine - labour accident based on jurisprudence, and in particular: I. Manifestation or worsening of a disease, II. Bodily harm or death, III. Mental disease, IV. Homicide, suicide and self-injury. The second (B’) part, and for the “Legal protection of Marine - labour accidents”, examines 1) Employer liability - Judicial pursuit for compensation, and in particular I. Compensation based on law 551/1915, II. Compensation based on common civil law - Claims based on tortious acts, III. Vicarious liability and third party concurrent liability, IV. Medical expenses - concurrent sickness pay and accident claims, 2) Other employer obligations for labour accidents – Other legal/procedural issues, and finally 3) Labour accident with international elements - Applicable law against private international law.
