DEALING WITH ADULTERY IN ANCIENT GREECE AND IN ANCIENT ROME
Summary:
The scope of this thesis was to research and record the responses of adultery in ancient Greece and ancient Rome, starting from the Homeric era and reaching the Justinian codification, while integrating the adultery within the legal framework of each region and each season.
Methodologically adultery was approached, on one hand, from sociological and moral point of view, particularly in relation to the institutions of family and marriage, to which it is inextricably linked, and, on the other hand, in legal terms as an offense and how they treated this criminal every time. That is why the analysis of ancient Athens and ancient Rome of the Augustan era follows a purely forensic approach, analyzing the crime of adultery regarding the objective and subjective elements of the crime and the penalties threatened against the adulterers in each case.
Finally, because the analysis of two periods identified commonalities of the two laws in dealing with adultery, there was an attempt for a comparative review of the two laws, in order to identify matching points or even influence and dimension points between them.
The investigation also demonstrated a large deviation of the treatment of adultery of the ancient world in comparison to remedy this by current laws, particularly taking into account the changing ideologies and ethical criteria in interpersonal relations of spouses and how this change has led to the decriminalization of adultery by most civilized states today.
