The greek cancellation judge on the verge of judicial and political power.An intertemporal research of his role in the protection of the environment from mining activities

Situated in the middle of strong social
conflict, the judge is called upon to play a new role, which
tends to become a leading one in the game of the modern Republic.
But is it so? What are the elements that lead us to
formulate the thesis on the strengthened role of the judge and how
novel is it? These questions will try to answer the first
part of our study, reserving a special place in the theoretical
case of the Americanization of the Greek courts and in general the Greek
justice system. Then the confirmation or refutation of our theoretical
findings will emerge through a comparative review of
case law (jurisprudence) for the years 1975 to date. Specifically, we detected the
points that reveal the freedom of action of the applicator of
law, both at national and European level and the role of
Cancellation judge in a field which has frequently been accused of
'' Activism '' beyond the tolerable limits in favor of the protection of the
environment. In order to limit the admittedly broad
investigation, the study will focus on judicial decisions
relating to the protection of the natural environment from mining
activities. At the above step, there are mainly recorded quantitative data,
while it is not attempted a detailed discussion of judgments,
on one hand due to the finite extent of the study, and on the other
because of the basic objective of the present study, which is the
investigation of law-civil-society-economy relations.
