Summary:
The new rules for public procurement and concessions were published early in 2014. The reform process laid bare the different preferences of and consequent tensions among the different actors of legislation. The result are provisions which are innovative in many respects, even where the rationale of the law is the same, but also very complex, making this area even more technical and incorporating the case law as it was developed by the Court of Justice of the European Union (CJEU).It is considered that the revised package represented an excellent overall outcome, with progress achieved on all of the priority objectives on issues such as thresholds, Part B services, exclusions, concept of "body governed by public law", utilities, modernizing procurement procedures, timescales, use of the competitive negotiated procedure, selection and award criteria, below threshold procurement, mutuals and public-public co-operation, better access for SME’s, supporting social policy goals, use of appropriate award criteria, use of contract performance conditions and innovation. This paper gives a total introduction on the new rules on public procurement.
