Summary:
The EU Member States are required to transpose the Directive 2014/41/EU on the European Investigation Order (EIO) in criminal matters into their national legislation by 22-5-2017. The Directive provides the regulatory framework of legal assistance in criminal matters regarding the collection of evidence between Member States. This paper discusses the key issues of the EIO and demonstrates the legislative procedure that was followed. In particular, the first part of this paper describes the pre-existing legal framework, the reasons that led to the birth of the Directive, the law-making process and the position of the EU institutions on the matter. In the second part, the provisions of the Directive are thoroughly analysed and a comparison with the previous drafts of the Directive is provided.
