Summary:
The purpose of this paper is to demonstrate the relation between spatial planning and tourism development in Greece. Spatial planning remained incomplete for several decades.The absence of planning reduced the prospects for sustainable economic development, by preventing, in some cases, ambitious investments, particularly in tourism. The Council of State managed to overcome the problems caused by the absence of integrated spatial planning by making use of smaller scale plans, such as the “Areas for Organized Development of Productive Activities”.
This paper examines the development of spatial planning, starting from the Constitution of 1975. The paper consists of two parts. The first one is more general and looks briefly into the policy pursued by the Greek State in the field of tourism, the relation between spatial planning and sustainable development, as well as the relation between spatial and urban planning.
The second, more specific part, looks into the development of legislation on spatial planning and the relevant case-law established by the Council of State, since the Constitution of 1975 until today. This paper attempts to approach the changes in legislation during the recent years of financial crisis and compare the new regulations with the older ones. Particular emphasis is laid on the establishment of productive activities, including tourism related ones, in specified areas. Furthermore, on the basis of case-law of the Counsil of State, the paper looks into the mοdern forms of spatial planning, regarding investments in public and private property ( Spatial Plans for the Development of Public Property (E.Σ.X.A.Δ.A – “E.S.H.A.DA”) and Spatial Plans for the Development of Strategic Investments (E.Σ.X.A.Σ.E – “E.S.H.A.S.E”)]. These new forms of planning attempt to reduce bureaucracy and consequently to attract profitable investements. However, the crucial issue, in all these cases, is to maintain a balance between the anticipated economic growth and environmental protection in order to achieve, according to the relevant constitutional requirements, a sustainable development.
