The applicable law regarding the property consequences of registered partnerships
Summary:
A registered partnership may give rise to property consequences issues, but the great disparities of the applicable rules in term of substantive law among states whose law provides for the institution of registered partnership, leads to the need to determine the proper private international law rule. In a first place, the current paper examines the private international law rules regarding registered partnership, as provided by in the Greek Law No 4356/2015, with emphasis on regulation of property consequences of registered partnerships and the substantive law (Part I). Then, the role of the European Union and the entry into force of the Council Regulation (EU) 2016/1104 will be examined, with reference on the provisions regarding the applicable law. The main objective is to point out the transition from the peculiar unilateral conflict rule towards a legal framework for private international law.
