Summary:
The statutory derived commitment of Public Administration presents a fairly large range, extending between absolute and very detailed formulation of special and specific imperatives and prohibitions to the full freedom of movements, always within the framework of the Constitution and laws. Both the inability to fully provision all of the cases that would apply in the future and legislators’ unattainable full knowledge of all cases, existing at the time the law is adopted, require freedom of movement, namely to act in discretion, in order to ensure flexibility and adaptability, necessary for the proper and fair management of all cases.
However, some public officials’ discretion to make decisions with regard to the allocation of state benefits or sanctions against citizens, has caused great concern, regarding the democratic scrutiny and accountability, in order to prevent them from evolving into small stubborn and uncontrollable persons in authority, before whom people would be really defenseless .
The tremendous momentum caused by the introduction of Information and Communication Technologies, besides the significant effects on many of the classic functions of the Public Service, has contributed significantly to reducing the scope of administrative discretion and its replacement, to a great extent, by digital decision trees, embedded in the code of specialized information systems. The decision-making process tends to be carried out, either by appropriate software, designed to issue decisions with the help of automated and standardized methods for assessing and evaluating cases, or in combination with the contribution of both specific computer programs, and bureaucrats, assigned with the limited role of the acceptance or rejection of decisions proposed by these information systems.
The introduction of ICT in Administration, has led to a sharp increase in opportunities for effective control and supervision over public institutions from the leadership, which seems to contribute to greater transparency and to the restriction of opportunities for bribery and corruption. The study that was conducted as part of the preparation of this thesis, regarding the correlation between the level of e-government and the level of corruption in a country, confirmed the existence of positive correlation between the two phenomena.
Nevertheless, the effect of technological modernization of administration in the process of issuing decisions in discretion, prompted new concerns about the need for the law and rules digitization and the consequent transfer of discretion from the classical level bureaucrats at the level of the information technologies experts, developers and designers of electronic systems, who constitute the modern version of the classical bureaucrats. Control and accountability of Information Technology experts, concerning the role will have over the process of the laws’ conversion into digital systems, which will decisively determine the nature, quantity and quality of sanctions and benefits that will be approved for citizens, plus the fact of a possible digital legal inflexibility of smart digital systems in applying discretion, that would lead to a denial of diversions from digitally imprinted rules, are reasonable concerns for the proper and unobstructed justice when assessing individual cases.
Given, however, the unpredictability of technology and the inability to secure provisions for general directions which may get in the future, it would be risky any absolute estimate of the effect that can have on the process of making decisions in discretion. The performance of any provision becomes even more difficult, especially in the case of the Greek Public Administration, which, despite the technological explosion that takes place over about three decades, has not yet managed to develop a new type of post - bureaucratic organizational structures, more flexible and result-oriented, unlike other European countries, despite the considerable efforts, that take place.
