Summary:
This study focusing exclusively on concentrations, aims first of all to approach resolution through “failing” firm concentrations and to access whether the 'failing firm defense' criteria, as used by the case law are capable of contributing to the rescue of businesses and to normalizing Crisis. At a second level, the research that follows will focus on the concentrations between Greek credit institutions, which despite having contributed most decisively to the recovery of the credibility of the Greek banking system raised serious competition concerns. The general question that arises every time the financial crisis is deepening, is whether maintaining systemic stability is an important reason for the "flexibility" of merger control rules and should therefore be preceded as such by the Competition authorities. This is a concern that, while touching on the 'fundamental' rules of competition, has not been the subject of a detailed examination.
