Summary:
The passing of Code of Conduct acc. to Law 4224/2013 for handling non-performing loans of private clients and businesses by the Bank of Greece has already been featured in theory; however, its implementation has not yet been widely implemented in court.
In the present study, after citing the descriptive elements for the Code and identifying difficulties in its implementation, we will examine some issues that have emerged in scientific research, such as the Institutionalisation of the Code, and therefore the legal nature of the relevant regulations. Also, we aim to define the legal right that ought to be protected regarding the regulations of the particular legal arrangement, which defines their nature as public or private law, in order to explore the possibility of legal consequences at non-compliance, other than the administrative sanctions explicitly defined in the Code, in contractual and tort level.
