Summary:
The purpose of this diploma thesis is first to investigate the development of piracy, its legal framework, the effectiveness of the measures taken by the international community and the European Union, in particular the interest to find solutions to this problem through the use of Private Maritime Security Guards (PMSPs), the legal framework for the security services provided by PMSPs on merchant vessels at international and national level, legal issues and problems arising from their actions, especially regarding the requirements of coastal states, port and flag states regarding their use, the issues of jurisdiction regarding their actions, the limits of their powers and the legal issues arising from the use and transfer of their arms. On a second level, the state liability for their action will be examined in accordance with international law and in particular due to excessive violence used by PMSPs and any violation of human rights. It will also be examined at a third level that the shipowner is liable for their actions in accordance with Greek law and, in particular, he faces liability as provided for in the security services contract between the shipowner and the Private Maritime Security Companies, hereinafter referred to as "PMSCs". Also, shipowner's liability will be examined in the framework of the contract of carriage, how it evolves within the framework of the employment of crew members' contract, how it develops in relation to damages to third parties and how the relevant insurance coverage is formed. Next, there will be an analysis of the Guardcon model contract and the comparison of its terms with Greek law.
