Methods of Detecting Lies in Criminal Investigation: Technological Developments and Comparative Law
Summary:
The lie detector, despite all the strong criticism he has received at times, is coming back to the legal and technological front more than ever. Regardless of the fact that it is incompatible in essence with our legal culture, as it impinges on basic constitutional provisions (S 2 para 1, 7 para 2 and 14 par. 1), but also to the provision of article 137A, paragraph 3 par. b. C.C., should not be used in cases where, in the absence of other evidence and always with the explicit consent of the accused, it could be used to form a forensic belief and to seek the substantive truth. However, it is of prime importance to choose the appropriate of the above mentioned methods and the existence of qualified scientists who can evaluate and verify the results.
