Summary:
This thesis attempts to study the phenomenon of Independent Authorities. In the first part, someone can see both the historical evolution of the institution internationally and in Greece, as well as the reasons for their foundation. A brief analysis of the concerns regarding the legal nature of the Independent Authorities (case law, legislation) follows. Also is being examined the “independency” of the Independent Authorities and the concerns about their democratic legitimacy, and their relationship with the foundations of the government. In the second part , the thesis focuses on the issue of the designation of the constitutionally Independent Authorities, referring to the minutes of the Revisionary House in an attempt to understand the choice of the legislator. Follows a short mention to the Independent Authorities of other countries, while in the last part is being underlined “the constitutional deadlock” of the past years. The thesis concludes with proposals for a more functional system for the Independent Authorities.
