Summary:
The new law 4443/2016 replaced the old one, law 3304/2005, and regulates the implementation of the principle of equal treatment irrespective of racial or ethnic origin, religious or other beliefs, disability, age or sexual orientation. Law 3304/2005 embodied Directives 2000/43/EC and 2000/78 / EC. The new law 4443/2016 embodies these directives with significant additions to the prohibited grounds and forms of discrimination and along with them the new Directive 2014/54/EU on measures facilitating the exercise of rights conferred on workers in the context of freedom of movement for workers.
The changes added to the new Law 4443/2016 are particularly important and aim at a multiple objective: The main purpose of the new reforms is the modernization of the discrimination law in Greece on the basis of the evolving social perceptions, the incorporation of the European and international jurisprudence in the Greek law of discrimination, the filling of legislative loopholes that the previous law (3304/2005) had, the Greek law unity and coherence on the field of discrimination, the incorporation of national investigations’ results, the satisfaction of minority groups’ - with a history of oppression -requests and finally the debt that the legislator in a democratic society has to form perceptions by giving to law a pedagogical character.
