Summary:
The effective application of bankruptcy law and the rapid completion of the work of bankruptcy was absolutely necessary, as often was the effect the work of bankruptcy to be completed in time beyond the decade, with harmful effects for all parties involved, but also the national economy generally. In the present is analyzed the new simplified bankruptcy proceedings applicable to small enterprises where is not appointed creditors' committee and the hearing of disputes during credit verification process is faster. The new simplified procedure adds the possibility of bankruptcy court to depart from the provisions of Bankruptcy Code, in order to indicate other, simpler procedurally and temporally shorter way of proceeding. It is described also the corresponding process on small enterprises, which is followed in the foreign law, in particular in the field of Italian, French, German, English and US law. Therefore, as is clear, the issue of simplified bankruptcy procedures is a common concern with international impact in order to reduce the bankruptcy procedure in cases where it is considered necessary to be implemented.
