Summary:
The main subject of this thesis in the part A’ is the institution of continuing crime as this is fixed in the article 98 of Penal Code, while in part B’ is presented concisely the criminological dimension of continuing in the light of serial killers. More specifally, in the part A’ are presented the historical justifying reason of existence and the “enigmatic” form and nature of the continuous crime, are analyzed so much the elements of paragraph 1 as much as the paragraph 2 who was introduced afterwards the modifications that involved the Law 2721/1999, but also the controversy that burst out with regard to the question of split of continuing crime in that of paragraph 1 with “ratio” the more lenient penal treatment of defendant and in that of paragraph 2 with “ratio” the stricter penal treatment of this. Special mention is made of the type of deceit in the context of continuing crime that depend on the Law 1608/1950, while in separate chapters are mentioned the positions of Case Law on the continuing crime as well as issues of diachronic right and more special questions. In part B’, reference is made to the murderers on a continuous basis after the necessary separations have been made both from the terminologies of the Penal Code and from the mass murderers, sketching out their profile and by approaching psychoanalytically-psychiatrically the case of Ted Bundy considered to be the archetype of serial killers. Closing, are formulated conclusions that they are made regarding both the need of “cleansing of” the institution of continuing crime by proposing solutions, and also in relation to the serial killers who, because of their particularity have been characterized as the “black hole” of criminality.
