The present paper discusses the significant theoretical and practical issue of the ambiguity of the action and the opposition from the Civil Procedure of 1834 to the present day and the impact of the judgement on this ambiguity, both on a procedural level (regarding issues of res judicata and discovery of the fundamental truth) as well as on an substantive law level (in terms of the limitation period of the claim at issue).
