Summary:
The present dissertation has as its object the market of natural gas and, in particular, its subsequent liberalization, which is the objective of the relevant EU policy in the context of creating a single internal market, while attempting to preserve its public interest nature. The abovementioned liberalization process has taken place by virtue of a regulatory framework established at EU level, and subsequently introduced into the national legislation of the Member States, as discussed in the first part of the thesis. In spite of the legislative framework adopted, the liberalization process has been delayed due, among other things, to the practices of the former state monopolies. In this respect, in the second part of the thesis, an attempt to critically evaluate some indicative trade practices is made, as well as a special reference to the ALUMINUM vs DEPA and DESFA case, which has been under the review of both the national Regulatory Authority for Energy and the Competition Commission since year 2009. DEPA has undertaken commitments which remain in force up to date. Finally, the thesis discusses the prevailing market conditions and the reasonably expected changes in the market arising out of the aforementioned legislative and case law developments.
