Summary:
The first part of this study focuses on the historical path of the right to protection of personal data from national norms in individual Member States to Council of Europe Convention 108 and ultimately in third generation legislation, in particular Directive 95/46 / EC. The second part attempts to outline the current EU legal framework for the protection of personal data as a duty of the Union and the Member States. The third and final part presents the legal framework that will apply to the transition to the digital single market, focusing on the General Regulation on the Protection of Personal Data and on the innovations it introduces to the existing regime.
