Τhird Party Funding in international investment arbitration
Summary:
Third Party Funding is a steadily increasing mechanism of international investment arbitration without, however, being the only one. Its origin and history reveal the litigant’s wish to have an access to justice. Investment arbitration is considered to be a much too expensive procedure. Despite this, investors are of the thought that this mechanism is the best solution for them in order to solve their differences with the host states. That is the reason why the third party funding is very popular. Nevertheless, some of the law researchers argue that this is a procedure with many disadvantages. In the present thesis some of them will be cited and how they prevent the development of third party funding.
