Summary:
The aim of the present thesis is to show that the reform of the European banking resolution framework, in the aftermath of the financial crisis of 2007/2008, is a step towards a more effective management of banking crisis. Yet, the adopted regime does not entirely address the problems aroused in distressed situations and considerable amendments are required. The thesis presents the main pillars of newly-introduced framework of the European Banking Union; an overview of the Bank Recovery and Resolution Directive; the function of the innovative bail-in tool; and lastly a critical view towards the bail-in, taking into account the current implementation of the tool and possible future developments which could make bail-in even more effective. The new regime reflects an underlying tension as to which goals prevail in the new regulatory regime; is it the protection of the financial stability and the internal market or the protection of the creditors?
