Summary:
The licensing of the trade mark is becoming more and more serious in trade. The particular nature of the legal relationship between the parties and between the parties and third parties needs to be deepened. Issues arise both with regard to the parties' rights and obligations arising under the contract and by law, as well as the rights and obligations of the parties to third parties under the contract and by law. The subject thesis examines the particular position of the licensee both vis-à-vis the trademark owner and third parties, indicating any concerns that need to be clarified, but also the general importance of the licensing through national and EU law and case law.
