Summary:
This dissertation is divided into two separate, yet consistent parts. In the first part, the international law on submarine cables and state practice relating to the regulation of submarine cables will be examined as well as the extent to which state practice is consistent with the law.
First, the dissertation explains why submarine cables are considered as a critical communications infrastructure. Next, it provides a brief overview of the international law relating to submarine cables. It then examines the problems with law and practice relating to cable operations and concentrates on the provisions provided by the United Nations Convention on the Law of the Sea (LOSC) . Additionally, it analyzes the legal regime which governs submarine cables adopting a detailed maritime zonal approach. More specifically, the analysis will concentrate on the territorial seas and archipelagic waters, the Exclusive Economic Zone (EEZ) and continental shelf and areas beyond national jurisdiction. It explores avenues for the settlement of disputes relating to submarine cables under LOSC in disputed areas. Finally, the first part will explore environmental issues which arise in relation to submarine cables operations, with a special focus on environmental requirements.
In the second part, the research will proceed with an analysis of the complex situation in the Eastern Mediterranean Sea. It will first provide the reader with information over the already existing agreements over maritime boundary delimitations between states bordering the Eastern Mediterranean region. To continue with, a systematic examination of the disputes which have arisen in the area will take place. Subsequently, we will conduct a thorough review and exploration of the project of the EuroAsia Interconnector submarine power cable which will constitute an energy bridge between Europe and Asia. The analysis will mostly focus on the possible routing of the project and the problems that are likely to emerge due to the existence of disputed maritime zones in the area. The aforementioned will be followed by a further investigation of the procedural processes which will need to be realized, namely the permitting process, the environmental obligations and the security measures which should be undertaken. Last but not least, it will be scrutinized whether there is any room for dispute settlement under the LOSC and the general international law concerning submarine cables in the Eastern Mediterranean.
