Summary:
The delineation between arbitration and litigation has been a major concern in European Union. The need for a transparent and sufficiently defined relationship between the two conflicting and often complementary forms of dispute settlement has had a significant impact on the formulation of the Brussels I Regulation on jurisdiction and the recognition and enforcement of judgmentsThe debate on this issue, which arises from the exclusion of arbitration from the scope of the Brussels Convention, is maintained both in the Brussels I Regulation (Rule 44/2001) and in the revised Brussels I bis Regulation (Rule 1215/2012) ). The behavior of the EU legislator and the evolution of the case-law of the European Court on the interplay between arbitration and litigation is examined in detail in this thesis.
