The principle of solidarity in the EU legal order
Summary:
The purpose of this work was to diagnose the position and importance of the principle of solidarity in the EU legal order through an effort to analyze the main "forms" it takes in the European Union both between Member States and between Member States and citizens. Already since the birth of the European Union, the fundamental concept of the principle of solidarity was realized in order for the European integration to be achieved in the best possible way.
The promotion of this principle at the same time as a value and a goal of the Union, which characterizes and governs its action at external and internal level, has demonstrated the need for Member States to have solidarity and to respect it. Through the Treaty of Lisbon, which was the cause of the references to solidarity both in the Treaty on European Union and in the Treaty on the Functioning of the European Union, the principle of solidarity gained a prominent place in the Union. The economic crisis that has plagued Europe in recent years, especially the southern countries, the refugee issue, the continuing terrorist threats and attacks on Europe, confirm the importance of solidarity and make it imperative to this value concept in the EU environment. Closer cooperation of the Member States is necessary to deal with those kind of issues. The principle of solidarity is based on reciprocity and shared responsibility, and only by acting in this way, combined with the other values of the Union, will Europe be able to overcome the trials it is experiencing.
