Time charters are contracts which define the terms and conditions of the relations between a ship owner and a charterer in regards with the use of a ship’s capacity for a certain amount of time, with respect to the carriage of goods by sea. The uniformity of regulatory rules for time charters is evident, especially if one only takes into account the fact that standard forms of charter parties reflect the international commercial practice and legal principles which govern the relations between the parties, thus offering both financial benefits and legal certainty.
NYPE has been and remains till this very day the most widely used standard time charter party in the dry cargo sector of the industry. However, the rapid developments in global economy as well as the legal developments of the past 20 years lead BIMCO to revise the form in 2015. The objective of the revision has been to produce a version of NYPE that will have global appeal and which takes proper stock of the most commonly applied amendments and additional clauses used by practitioners in the dry cargo sector. Most amendments are focused on the reassignment of the parties’ liability as well as the better definition of their rights and responsibilities with the view of clarifying certain issues that tend to arise during the course of the enforcement of the contract.
The current study examines the new amendments and attempts to assess their content based on the principles of English law, which is most frequently used under these circumstances for the formulation and interpretation of time charter parties on an international level.
