Summary:
The purpose of this paper is to present the legal framework at European and national level for the prohibition of discrimination in the field of employment and occupation, through the analysis of Directives 2000/43 / EC and 2000/78 / EC, Greek law 4443/2016, which replaced the previous Law 3304/2005 and the related WEU case law.The objective of anti-discrimination legislation is to create the conditions for a labor market conducive to social inclusion.Discrimination means both direct discrimination and indirect discrimination as well as harassment.The relevant legislation covers all persons working both in the private and public sectors and applies at every stage of the employment relationship, from recruitment to dismissal.Protection against discrimination is provided in accordance with the protected features mentioned in the relevant provisions, and exceptions are only allowed for the reasons that specificly mentioned in the relevant legislative texts, and according to the requirement of respect for the principle of proportionality.In order to ensure that protection against discrimination is also at a substantive level, the relevant legislation provides the possibility of taking positive measures to remove or reduce existing inequalities. Τhe relevant legislation also provides the imposition of sanctions against those who violate non-discrimination provisions, these sanctions should be effective, proportionate and dissuasive.Last but not least, in order to ensure effective judicial protection for victims of discrimination, there is some evidentiary facilities concerning the reversal of the burden of proof.
