Summary:
The aim of this study is to approach the issues raised in the interpretation and application of the offense of criminal breach of trust by civil servant under Article 256 of the Criminal Code. To this end, the first goal of this study is the interpretative approach of the individual constituents of the objective state of the crime, with emphasis on the central concept of the civil servant as active subject of criminal breach of trust, to the protected by it "public" property as well as to the individual management acts that make up the criminal breach of trust behavior. It analyzes the subjective nature of the offense, its forms of appearance and highlights aspects of participation in it. Secondly, there is a brief analysis of the legal form of common infidelity, so that the common points, the differences and the problems they present can be easily understood by comparing the two provisions (Articles 256 and 390 CC). Thirdly, individual issues such as the conjunction of criminal breach of trust with other offenses of the Criminal Code are set out, the relevant consideration is given to the application of the particularly distinguished variants of Law 1608/1950 in relation to the offense of criminal breach of trust by civil servant, special leniency provisions concerning the more favorable treatment of perpetrators under Article 256 of the Code of Criminal Procedure. At the same time, in each section, the positions of theory and jurisprudence are presented on each individual issue, which are used to approach the problems discussed. Finally, the proposal de lege ferenda for improving the current legal framework is briefly presented.
