The guardianship of Minors and the role of Prosecutor of Minors as temporary guardian to the unaccompanied minors refugees

The guardianship of minors in Greece according to the Greek Civil Code. A special issue of the study is the situation of unaccompanied minors and separated children seeking international protection in Greece combined with the problems they face in practice. The study analyzes the qualifications that the Guardian assigned to unaccompanied minors refugees should have, the procedure for defining them, the tasks to be assigned and the control to which he is subject in order to fully and holistically protect the rights of the minor as defined the Convention on the Rights of the Child on the basis of its best interests and the creation of an integrated child protection system. Furthermore, the guardianship systems of other EU Member States are presented. Also the real situation in Greece regarding the extremely important issue of unaccompanied minors is described in accordance with the current legislative framework along with the role of the Prosecutor of Minors as a temporary Guardian Lastly, it is proposed to the Greek legislator to establish the most appropriate system of guardianship for unaccompanied minors.
