Summary:
This work attempts to present and analyze the European Union's action in the field of tourism to date: initially as initiatives through other Community policies - such as the internal market and the environment, where Member States have already been assigned competence - (and) on the basis of the newly-established provision of the TFEU 195 on tourism. The Union, not initially in charge of coordinating or harmonizing individual national tourism policies, has tried to serve as much as possible the needs of tourists and other players in the tourism industry through its other fields of action. The Union and the Member States are now being called into dialogue to reconcile. The TFEU 195 indicates that it understands the need to maintain tourism policy under national sovereignty, but the path towards consolidation can not be dealt with and degraded. This provision assigns a "relaxed" competence to the EU, complementary and co-ordinating in terms of prima facie irrelevant national action. It remains to be seen, however, whether the Union will suffice to try to frame individual national tourism policies, or whether it will move towards shaping and enforcing a single Community tourism policy.
