Summary:
The present thesis is examining the relationship which is developing between international commercial arbitration and EU competition law, both at a substantive as well as at a procedural level, identifying the meeting points and the points of departure. As regards the substantive part, attention is given to the arbitrability of antitrust disputes, to the application of EU competition law in pending arbitral proceedings, as well as to issues of public policy and EU competition law arising at the recognition and enforcement of arbitral awards. The procedural part is addressing the issue of cooperation between arbitral tribunals and the EU Courts (direct or indirect preliminary references for the interpretation of EU Competition Law, the role of anti-suit injunctions in the evolution of the relationship between arbitration and the EU judicial system), as well as between arbitral tribunals and the members of the European Competition Network (interference of the members of the European Competition Network in the course of arbitral proceedings, communication of arbitral awards, conflicting decisions and stay of proceedings).
