Legal standing and legal interest in the new special proceedings of family disputes

The amendment of the Greek Civil Procedural Law under law 4335/2015, introduced the systemisation of the special proceedings and the creation of the new special proceedings of family disputes, which includes the matrimonial matters, the disputes arising out of the relations between children and their parents, and the disputes of the former Article 681B of CCP. The subject of these disputes is the formation, the protection and the recognition of family rights. Their personal character, in combination with the high number of persons that they affect, and with the need for secure and certain family relations, shows the need of legal research on the issues of legal standing and legal interest of the trials concerned. The aim of this dissertation is to determine which persons are legalised to sue and to be sued at the several family trials, whether they are rightholders or not. Furthermore, it attempts to codify the issues of legal interest, concerning in its special character in Family Law ,its influence in the legal standing, in case of declaratory acts ,as well as its treatment in the several procedural acts.
