The right to energy in Public International Law
Summary:
The procedure of crystallizing a right is always a long and, at the same time, dynamic process: first the social need for this right to be established is ascertained, and then the conventional texts start to have a different interpretation, in order to serve this need. Finally, the soft law texts emerge, regarding this topic: as Alexander Sicilianos has pointed out, the evolutionary approach of the legal science is the one considering the making of the law as a lively condition. After all the aforementioned, it is reasonable that for the basic need for an uninterrupted and access of high quality to energy, which has been ignored by the public international law until today, the time has come to be introduced to the international human rights law system. This thesis examines and deepens further to the preconditions of a right to energy, and suggests a framework in which such a right could be established.
