Summary:
The present thesis deals with the issue of the resolution of international disputes over cultural goods. It consists of two main parts, while in the third part two up-to-date issues that concern the international community are analyzed. The first part, a theoretical approach of the subject, initially attempts to accurately define "cultural heritage" and "cultural goods" and the distinct the latter into various categories, while it continues with the historical evolution of the illegal transfer of cultural goods from the antiquity to the present. The first part ends with the examination of the legal framework through the international and European law as well as the legal framework from the perspective of some national laws of particular interest.
On the other hand, the second part analyzes under the current pragmatic situation the procedural matters on the resolution of a dispute over cultural goods. To start with, a comparison overview of the various judicial forms is carried out, which is followed by the presentation of practical aspects of the applicable law, the debatable issue of jurisdiction in order an effective solution to be achieved and the reparation. Finally, a brief overview, as it has formed nowadays, on the case law is cited.
The third part, finally, examines two current issues that have drawn the international interest and need to be examined separately. The first, deals with the debatable issue on cultural goods’ ownership, while the second concerns with the very famous case of the Parthenon marbles, with a brief historical background and the quotation of some thoughts and discussion for its effective resolution.
