Summary:
When art draws its subject from social reality, the conflict between freedom of art and the right to personality of individuals, whο become recognizable through artistic expression, will be inevitable. Giving solutions to this conflict is particularly difficult, not only due to the lack of specific legislation, but also to the inherent quirk of art as a field that cannot be clearly defined. In the present research this conflict is first considered in the light of the provisions of the Civil Code (AK 57 et seq.). Then the thesis attempts to tackle the issue from the scope of personal data legislation. Particular reference is made to the conflict between freedom of art and the right to one΄s own image. Eventually, the thesis refers to the conflict between the creator’s moral intellectual right -through which the legislator practically specifies the constitutional right of freedom of art- and one’s right to personality.
