Summary:
This paper is a Diploma Thesis, which was conducted within the framework of the Postgraduate Program in the Public Law Section of the Law School of the National Kapodistrian University of Athens. Its subject is "The Confidentiality of Communications in accordance with the with the jurisprudence of the Council of State". The analysis of the matter is made from the point of view of the Public Law only and based on the existing Law of the Council of State of the last decade (2007-2017). Therefore, other aspects of communications secrecy (criminal, procedural or other) can be the subject of a separate diploma thesis within a postgraduate program in another field of law or in general of other science are not thoroughly analyzed. Due to the technological development and its impact on the telecommunications sector, we focused mainly on issues that have recently been addressed by the Jurisdiction and occupy cases of almost all the major modern communication and communication tools (mobile and fixed telephony, e-mail, mail, internet, etc.). The main aim of this postgraduate essay is to highlight the important legal issues in the field of telecommunication and in particular the protection of the individual's right to the confidentiality of communication in the modern digital world of information as they emerged from the study of its case law Council of State.
