Investment Treaty Arbitration as a compliance mechanism with commercial arbitral awards
Summary:
International commercial arbitration prevails as the most dominant adjudicative method in order to have commercial disputes settled. Despite the alleged "autonomous" character of arbitration, it undergoes the interference of national fora not only as New York Convention for the recognition and enforcement of foreign arbitral awards imposes but also due to the application of the lex loci arbitri and the mandates of the law of the seat of the arbitration. Could Investment treaty law play a significant role towards the protection of commercial arbitral awards or arbitration proceedings in cases a "malaise" interference of national fora occurs (breach of the New York Convention, or abusive application of the law of the seat)? Not only is this issue related to a rationae materiae question regarding the definition of investment but also encapsulates a fascinating interplay between commercial and investment arbitration which expresses the realm of arbitration as an indistinguishable whole. This thesis examines mainly three theoretical perspectives related to the possibility to have arbitral awards deemed as investments. It also underscores the nature of arbitral awards, the 1958 New York Convention for Recognition and Enforcement of foreign arbitral awards as well as the possible use of investment treaty arbitration as a remedy of last resort in favour of an arbitral award creditor and the possible implications or impact of this use as far as commercial and investment arbitration are concerned ("a ship in a wolf's clothes or vice versa?”).
