This dissortation attempts to examine the historical and sociological aspects of the death penalty institution, according to the theories of Garland, Foucault, Rusche and Kirchheimer and Kourakis. Afterwards, it aims to analyse the retainance of the capital punishment in America today and a brief report is also included for the use of the death penalty in the former U.S.S.R. Finally follows an exposition of the arguments for and against the death penalty.
