European energy policy and public contracts

The purpose of this dissertation is to discuss the European energy policy, the energy market liberalisation, and their importance for the public contracts’ domain. Energy policy is now under the explicit jurisdiction of the European Union and it is based on the supply security, the competitiveness of the economy, and the environmental sustainability. Three bundles of legislations have gradually led to the energy market liberalisation and the development of a competitive internal market, whereas the fourth “Package” constitutes a new proposal. Therefore, the vertically integrated public enterprises are losing monopoly privileges, at least in competitive fields, where rules of free competition now apply. Regarding public contracts in the energy sector a specific legislative framework is required, which however does not apply when the contract is subject to an activity directly exposed to competition. In this context, three major issues arise in the public contracts’ domain. First, how does former public enterprises’ contractual activity develop, given that they might fall under stricter constraints from the public contract law compared to their competitors. Second, how do contracts of public entities develop for services and goods that are not competition free, and finally, whether and how much a decrease in public contracts constitutes a problem.
