Summary:
This master thesis mainly aims at the investigation of the problematic of the normative limits of an autonomous act that endangers the legally protected right to life against the state obligation to protect its material substance. Primarily, a conceptual approach of personal autonomy is attempted under the scope of both the Kantian conception of the notion as well as the later modern/ libertarian approach in order to underline the normative validity of self-destructive will of the hunger striker under interment conditions. Moreover, the extent of the state obligation to ensure the physical integrity of the hunger striker is explored by analyzing core decisions of the European Court of Human Rights, according to the libertarian or the paternalistic approach of personal autonomy. The last chapter focuses on the notion of the «voluntary» as a decisive factor of the normative repercussions of hunger strikes centered both at one prisoner that directly targets at his death as well as at self-destructive acts that are developed within a social frame. Finally, the possibility of discovering the authentic, true will of the hunger striker, in the case of an unconscious prisoner, is investigated, while the proper treatment of the hunger striker under the scope of the Greek legislation is outlined.
