Summary:
Management of non-performing loans ("red loans") is among the most significant problems faced by the Greek economy and especially the domestic banking system the latest years. One of the measures taken by the State in order for such a serious problem preventing the economic recovery of enterprises to be addressed was the provision of special administration regime of L. 4307/2014. Said procedure circumvents the long-lasting procedures provided by the Bankruptcy Code and focuses on the prompt liquidation of "alive" over – indebted enterprises affecting positively not only on the satisfaction of their creditors but also the safeguard of positions of already employed personnel and generally the maintenance of unemployment on low rates.

The special administration procedure is not provided by the Bankruptcy Code but by a separate legislative framework. The procedure of special administration follows the model of the special liquidation procedure of art.106ia BC abolished by L. 4446/2016 and aims to provide an alternative or "second" solution to an over-indebted but viable enterprise in order to be quickly rescued from its debts in a pre-bankruptcy stage without suffering from the adverse consequences of bankruptcy.
