Summary:
The increased mobility of companies and businesses in combination with the extended financial hardships mainly of the last few years, have rendered international insolvency law to a major element for the regulation of international transactions and the assessment of the risks in the international business environment. The insolvency of companies as an adverse development of the cross-border mobility directly affects the proper function of the internal market and as a result the adoption of international legislation is required for the harmonized and uniform regulation of the cross-border insolvency proceedings.
This thesis attempts to address the phenomenon of European cross-border insolvency proceedings through the principle of universality, (Regulation 1346/2000 and Regulation 848/2015), as it is crystallized in the context of the applicable law. More precisely, on a first level, the focus is drawn on the lex fori concursus rule, the law of the State in which the insolvency proceedings are opened, and on the ratio which prompted the European legislator to introduce exceptions to that rule by means of a simultaneous review of those rules. On a second level, particular emphasis is placed on the exclusion of the rights in rem, which is one of the most important exceptions to the lex fori concursus rule, as well as on the position that these rights hold in modern international trade. This position is mainly justified by the adoption of a credit policy by the Member States, a prerequisite of which is the security of the claim through the creation of limited securities of value. Lastly, in an attempt to highlight the relative nature of the protection afforded by European law to the insured creditor, consideration is given to the opening of a secondary insolvency procedure in another Member State, as well as to the cases of defaulting behavior of the debtor or the insured creditor, a behavior which is rendered harmful for the collective satisfaction of the creditors of the insolvent person.
