Summary:
This paper analyzes the mechanisms of private international law to combat global corruption. The aim of this study is to understand how private international law helps the fight against international corruption, with emphasis on the private sector. The first section provides a critical review of the most important international conventions aimed at fighting corruption. To combat a global phenomenon, such as transnational corruption, the need for standardization of Private International Law was formed early on. Subsequently, the mechanism of jurisdiction is analyzed, mainly in the framework of the Council of Europe Convention on Civil Law on Corruption. International conventions include specific provisions for the establishment of State jurisdiction in disputes where a matter of corruption is raised and more jurisdictions are involved. The approach of international corruption as a problem of public and criminal law changed with the adoption of the Civil Law Convention on Corruption by the Council of Europe. The Civil Law Convention on Corruption is of particular importance in private international law, as it is the first legal instrument that established the civil claim of compensation for the victim of corruption. Major cases of civil compensation claims in the field of international transactions are analyzed and then the examination of corruption claims in arbitration procceedings is approached. The controversial case of the Siemens Scandal in Greece offers an important food for legal concern. In the last section the initiatives of the Greek Law against corruption, in the criminal, public and private sector are analysed, and solutions for more effective compliance with the requirements of the current international legal regime against corruption are proposed.
