EUROPEAN ACQUIS IN COLLECTIVE BARGAINING
Summary:
This study aims to illuminate the European acquis in collective bargaining in the areas of labour law, through the analysis of social dialogue, legal systems and mechanisms. To achieve that,in Chapter A ,we analyze the meaning of social dialogue at national and European level, as an integral part of collective bargaining between employers and employees. In Chapter B ,an inductive study of international and European law considering collective bargaining is conducted, European Convention of Human Rights and European Social Charter as well as International Labour Conventions on collective bargaining included, when the self executing of those rights is investigated in order to better understand the efficiency of the rules provided. In Chapter C we present the role of the European Committee of Social Rights, the European Court of Human Rights and the European Court of Justice in promotion of the European acquis in collective bargaining in the view of some important rulings released and, finally, in Chapter D we conclude ,having as an additional, useful tool some observations from the ILO Committee References ,emphasizing the issue raising about how possible is the effective implementation of international and European labour standards and the enforcement of the collective labour law under financially challenging circumstances ,that the indications show the decrease of European acquis in collective bargaining in our country where collective bargaining is under pressure.
