The right to freedom of expression in the European Union

This paper deals with the regulatory validity of the right to freedom in the European area. It is attempted to distinguish the essence of the right by analyzing this extent in comparison with the legitimate or non-legitimate interference in the core of the right. The first part analyzes the foundation of the right as an precise freedom inherent in the individual and the inalienable dignity enjoyed in a democratic society. The impact of the right to citizens' confidence in the European community of ideas and values explains the need for a strong regulatory provision that for years lacked this judicial system. In this context, the course of case law based on judicial configurations, explanations and foundations covered the gap in law, until the clear provision limited the previous activism. In the second part, the selective analysis of the case law of the Court of Justice of the European Union and the European Court of Human Rights aims at the more detailed, though necessary, case-detection of possible violations.
