The termination of public procurement
Summary:
The main subject of this study is the early termination of public procurement, in other words, the termination of public construction or supply or services or study contract, which takes place before the completion of the conventional object. The subject of study is examined by two respects, on the one hand by our National Legislation, on the other hand by European Legislation, highlighting the different guidance and the different perceptions. Particularly, the first chapter is devoted to the Greek legal order, which is focused on a conventional logic. The Greek legal order considers that the early termination is the key that resolves the problem between the contracting parties. The second chapter is referred to Community legal order, which is orientated towards the single market–without internal borders- believes that the key for the early termination is the free and undistorted competition.
