This essay aims at an extensive study of the guarantees provided by Article 5 of the European Convention on Human Rights to persons deprived of their liberty due to arrest or temporary detention, i.e. without an irrevocable judicial decision. In particular are examined the evolving case law of the he European Court of Human Rights (ECHR), its principles as well as the intense debate that has been created in the circles of theory due to the Court’s ambiguous decisions.
