Summary:
The purpose of this paper is to analyze and interpret the concept of judicial evidence over time through theory and case law. Judicial evidence means anonymous evidence, which can help in revealing the truth but does not fit into the categories of branded evidence. Such judicial evidence is, for example, evidence of witnesses in another political or criminal proceedings, an expert's report carried out in another trial, affidavits taken at an indefinite time before the trial or in another procedure, decisions of civil, criminal and administrative courts and, on the other hand, third parties, such as letters, statements and third party testimonials, even in the form of Article 8 of Law 1599/1986, provided however that the judicial evidence in question has not been produced for the purpose of use them in this trial. The use of pathological evidence forms can be tolerated only within well-defined interpretation limits. The observance of basic principles and rules, which provide the necessary safeguards, inter alia, for the correctness of the evidence and the right to be heard and the parties to be heard, is the overriding aim of the evidentiary procedure, which can not even be prejudiced when the law itself permits the use of informal or incomplete means of proof. The right solution must therefore be between reconciling the two objectives of the evidence-based process: finding the truth and adhering to procedural rules. The balanced coexistence of these two objectives, within predefined and rigorous frameworks, helps to create a more secure forensic conviction and ultimately leads to the achievement of legal certainty.
