Summary:
This paper focuses on the collision of the right to privacy and the right to the freedom of speech. Specifically, the paper is concerned with the extent to which a prima facie illegal violation of a person’s right to private life may be legitimated solely by the purpose of a subsequent publication of the information that was sourced, in the name of the contribution to a ‘debate of a general interest’.

It will be examined whether a violation of the right to privacy which occurred at the stage of data collection affects the legality of the publication, especially in the light of the European Court of Human Rights jurisprudence. Initially, it will be asserted that such violation does not renders the publication illegal ipso facto.

Subsequently, this paper will attempt to dogmatically and morally approach the issue raised, in order to proceed to the examination of the relevant jurisprudence. The latter reveals three stages during which the criteria according to which the Courts and the literature have tackled the issue of the illegally sourced information have been shaped.

Finally, this paper concludes that the constant pursuit of an equilibrium between two opposing rights is inherent to the notion of the ‘fair balance', which constitutes the Court’s decisive tool in the exercise of balancing the right to privacy and the right to the freedom of speech- for non of which there is an a priori call for special protection.
